There was a patch put together for this sometime mid 2005 which fixed persistence failures for me. It appears that the patch was committed into 2.6.13.3 (as per http://www.kernel.org/pub/linux/kernel/v2.6/ChangeLog-2.6.13.3) so anything after that *might* fix your problems.
